Term of Service Agreement Status for Get User Info

Is there anyway through the API to get at the value for 'Term of Service Agreement'?  Can it be set through the API?  Any assistance would be greatly appreciated.  I'm trying to update a user's status but this fails if they haven't agreed to the terms,,,,
